Terms of Service (AGB)

1. Scope and Provider

1.1 Scope

These Terms of Service ("Terms") govern the use of the myceve platform (available at https://myceve.app), an AI-powered career page builder service ("Service"), provided by:

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you must not use the Service.

1.3 Amendments

We reserve the right to modify these Terms. Material changes will be communicated via email or in-app notification at least 30 days before they take effect. Continued use after the effective date constitutes acceptance of the modified Terms.

2. Description of Service

2.1 Core Service

myceve provides an online platform for creating, editing, and managing professional CVs with AI-powered adaptation capabilities. Users can upload existing CVs, enter personal and professional data, select design themes, and export finished CVs as PDF documents.

2.2 AI Adaptation

The Service includes AI-powered features that analyze job postings and adapt CVs accordingly. AI processing is performed by third-party providers (Anthropic Claude and Google Gemini) and is enabled by default as part of the core service. You may disable AI processing at any time via your account settings. AI-generated content includes source references to verify accuracy. For CV adaptation, personal contact information is excluded through data minimization; for cover letter generation, contact details are included as required by the letter format.

2.3 Service Availability

We strive for high availability but do not guarantee uninterrupted access. Scheduled maintenance will be announced in advance where possible. We are not liable for downtime caused by third-party service providers, force majeure, or circumstances beyond our control.

3. Plans and Pricing

3.1 Free Plan

The Free plan includes:

• 1 CV creation
• 3 basic themes
• 3 color palettes
• PDF export
• Basic AI optimization

3.2 Pro Plan

The Pro plan is available at €9 per month or €90 per year (billed annually; local currency equivalent via Stripe where applicable) and includes:

• Unlimited CV creations
• All 21 premium themes
• 19 color palettes
• 28 font options
• Custom CV URLs (slugs)
• Priority PDF export
• Cover letter generator
• ATS scoring, interview preparation, and skills gap analysis
• Priority support

3.3 Pricing Changes

We reserve the right to change pricing with 30 days' advance notice. Existing subscriptions are not affected until their next renewal.

4. Payment and Subscription

4.1 Payment Processing

All payments are processed securely through Stripe. We do not store your payment card details on our servers.

4.2 Subscription Renewal

Pro subscriptions renew automatically at the end of each billing period (monthly or annually) unless cancelled before the renewal date.

4.3 Cancellation

You may cancel your Pro subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period. You retain access to Pro features until that date.

4.4 Refunds

Refunds are handled in accordance with our Cancellation Policy and applicable consumer protection laws.

4.5 Late Payment

Subscription payments are processed immediately via Stripe at the time of sign-up and upon each renewal. In the event that a payment fails and remains unresolved within 14 calendar days, we are entitled to charge default interest at the statutory rate of 5 percentage points above the base interest rate for consumers (§ 288(1) BGB) or 9 percentage points above the base interest rate for businesses (§ 288(2) BGB). We reserve the right to suspend access to Pro features while payments are overdue.

5. User Accounts

5.1 Registration

Certain features require a user account. You may register using an email address or social login (via Clerk). You are responsible for maintaining the confidentiality of your account credentials.

5.2 Anonymous Use

Limited features are available without an account. Anonymous sessions expire after 7 days of inactivity (auto-extending on use). CV data created during anonymous sessions is automatically deleted after 30 days if no account is created.

5.3 Account Termination

You may delete your account at any time through the account settings. We may suspend or terminate accounts that violate these Terms, with prior notice where practicable.

6. Intellectual Property and Content Ownership

6.1 Your Content

You retain all ownership rights to the personal and professional content you provide to the Service (CV data, uploaded documents, photos, etc.). By using the Service, you grant us a limited, non-exclusive license to process this content solely for the purpose of providing the Service.

6.2 AI-Generated Content

AI-generated adaptations (rewritten sections, optimized content) are derived from your original content. You are granted a perpetual, non-exclusive, royalty-free license to use, modify, and distribute the AI-generated adaptations for your personal and professional purposes. We do not claim ownership of AI-generated adaptations of your content.

6.3 Platform Content

The myceve platform, including its design, themes, code, graphics, and branding, is protected by copyright and intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of the platform.

6.4 Theme Designs

CV themes and templates are licensed for use within the Service. You may use CVs generated with our themes for any personal or professional purpose, but you may not extract, redistribute, or sell the theme designs themselves.

7. User Obligations

7.1 Lawful Use

You agree to use the Service only for lawful purposes. You must not:

• Upload false, misleading, or fraudulent information
• Upload content that infringes third-party intellectual property rights
• Attempt to access other users' data
• Reverse engineer, decompile, or disassemble the Service
• Use automated systems to scrape or extract data from the Service
• Abuse the AI features to generate harmful, discriminatory, or illegal content
• Circumvent usage limits or technical restrictions

7.2 Accuracy

You are solely responsible for the accuracy and truthfulness of the information in your CV. AI-generated adaptations are suggestions that you should review and verify before use.

8. Data Protection

We process personal data in accordance with our Privacy Policy. By using the Service, you acknowledge that your CV data is transmitted to third-party AI providers (Anthropic and Google) located in the United States for AI-powered features. For CV adaptation, personal contact information is excluded; for cover letter generation, contact details are included as required. AI processing is part of the core service and may be disabled via account settings.

8a. AI Transparency (EU AI Act Art. 50)

In compliance with the EU AI Act (Regulation (EU) 2024/1689), we disclose the following about our use of AI systems:

• AI-generated content: All CV adaptations, cover letters, ATS scores, interview preparation content, and skills gap analyses produced by our Service are generated by AI systems (Anthropic Claude and Google Gemini). Such content is clearly labeled within the application interface.
• Human oversight: All AI-generated content is presented as suggestions for your review. You retain full editorial control to accept, modify, or reject any AI-generated output before it is used.
• Limitations: AI-generated content may contain inaccuracies. Source reference validation and confidence scoring (minimum threshold: 0.75) are applied to mitigate hallucination risks, but users should independently verify all AI output.
• Data usage: Your data is not used to train AI models. AI providers process data solely for the purpose of generating responses per their respective data processing agreements.

9. Liability

9.1 Limitation of Liability (German Law)

To the extent permitted by law, our liability is limited as follows:

• Intent and gross negligence: We are liable without limitation for damages caused by intent or gross negligence.
• Simple negligence: We are liable for breaches of material contractual obligations (Kardinalpflichten) only, limited to foreseeable, typical damages.
• AI-generated content: We do not guarantee the accuracy, completeness, or suitability of AI-generated CV adaptations. Users are responsible for reviewing all AI output before use.

9.2 Exclusions

The above limitations do not apply to liability under the German Product Liability Act (Produkthaftungsgesetz), for injury to life, body, or health, or for damages arising from the absence of guaranteed characteristics.

9.3 US Customers

To the maximum extent permitted by applicable law, the Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Our total liability shall not exceed the amounts paid by you to us in the 12 months preceding the claim.

9.4 UK Consumers

Nothing in these Terms affects your statutory rights under the Consumer Rights Act 2015. Where the Service does not meet the statutory standard, you are entitled to the remedies provided by UK law.

9.5 Force Majeure

We are not liable for failure or delay in performance due to circumstances beyond our reasonable control, including natural disasters, pandemics, government actions, failures of third-party service providers, or internet outages.

10. Export Control and Sanctions

You agree to comply with all applicable export control laws and trade sanctions, including those of the European Union and the United States. You may not use the Service if you are located in a sanctioned country or are on any government restricted party list.

11. Warranty

The Service is provided "as is" and "as available" to the extent permitted by applicable law. We warrant that the Service will be provided with reasonable care and skill. Statutory warranty rights under German law remain unaffected.

12. Termination

12.1 By User

You may terminate your use of the Service at any time by deleting your account. Account deletion includes a 14-day grace period during which you may cancel the deletion request. After the grace period, all data is permanently removed. Pro subscriptions can be cancelled at any time, effective at the end of the current billing period.

12.2 By Us

We may terminate or suspend your account for material breach of these Terms after providing reasonable notice and an opportunity to cure, except where immediate termination is necessary to prevent harm or comply with legal obligations.

12.3 Effect of Termination

Upon termination, your right to use the Service ceases. We will delete your data in accordance with our Privacy Policy and applicable retention requirements.

13. Governing Law and Jurisdiction

13.1 Governing Law

These Terms are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). For consumers within the EU, mandatory consumer protection provisions of their country of residence remain applicable.

13.2 Jurisdiction

For merchants (Kaufleute), legal entities under public law, and public-law special funds, the exclusive place of jurisdiction is Berlin, Germany. For consumers, the statutory provisions on jurisdiction apply.

13.3 US Customers

For users located in the United States, to the extent German law proves unenforceable, the laws of the State of Delaware shall apply as a fallback, without regard to conflict of law principles.

13.4 UK Consumers

Consumers in the United Kingdom retain the benefit of any mandatory provisions of UK law, including the Consumer Rights Act 2015, regardless of the governing law chosen by these Terms.

13.5 Online Dispute Resolution

The European Commission provides an online dispute resolution platform at https://ec.europa.eu/consumers/odr. We are not obligated to participate in dispute resolution proceedings before a consumer arbitration board.

14. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. The invalid provision shall be replaced by a valid provision that comes as close as possible to the economic purpose of the invalid provision.
